General Data Protection Regulation (GDPR) Schladming-Dachstein Tourismusmarketing GmbH

The protection of your personal data is a top priority for us. We process your data exclusively on the basis of applicable statutory provisions (GDPR; 2003 Telecommunications Act). In the data privacy policy at hand, we inform you about the most important aspects of how we process data within the scope of our activities.

Contacting us

If you contact us via the contact form on the website or by email, the data you give us will be used to process your inquiry and will be saved by us for 14 days in case of follow-up questions. We will not pass your data on without your consent.

Data storage

For the purpose of a smoother shopping process and for subsequent contract processing by the webshop operator, the IP data for your connection and the purchaser's contact information are stored in cookies.

The data provided by you are required for contract fulfillment or in order to take steps prior to entering into a contract. We cannot complete a contract with you without these data. No data will be transferred to third parties, other than credit card data to the processing bank institution/payment service in order to debit the purchase price, the contracted shipping/transport companies for delivery of the goods, and our tax consultants in order to meet our tax obligations. 

If the purchase process is canceled, the data stored by us will be deleted. If the contract is completed, the requisite data from the contractual relationship will be stored for the obligatory tax retention period (seven years).

Furthermore, the data items: name, address, goods purchased, and purchase date will be stored for the product liability term of ten years. Data is processed on the basis of the legal provisions in section 96(3) of the German Telecommunications Law (Telekommunicationsgezetz TKG), Article 6(1)(a) (“Consent”) and/or (b) (“Necessary for the performance of a contract”) of the GDPR.

Cookies

Our website uses “cookies”. These are small text files that are stored on your device via your browser. They do not cause any damage.

We use cookies in order to make our website more user-friendly. Some cookies will be stored on your device until you delete them. They allow us to recognize your browser on your next visit.

Web analysis

Matomo

This website uses Elements Analytics, a web analytics service and targeting technology based on the open source product Matomo provided by elements.at New Media Solutions GmbH („Elements“). This service uses so called “cookies”, which are basically text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website will be transmitted to Elements on servers in the EU and are permanently stored for further processing. By adopting the privacy-by-default concept, the IP address will be truncated and only processed in abbreviated form and exclude a direct reference to individuals. Additional notes login-area on website


By using the login area on our website you accept the transmission of your unique user identification (ID) on our website to Elements. This ID doesn't have any direct reference to individuals by itself and has is only meaningful in combination with the the profile data (user profile) stored on this website. The collected data by Elements is merged partly or entirely with your profile. On Elements' servers it's impossible to create a direct reference to individuals by the provided ID information and no further personal data is transferred to the servers of Elements. 
 

Google (re)marketing Services

On the basis of our legitimate interests (i.e. interests in the analysis, optimization and economic operation of our online services in the sense of Article 6(1)(f) GDPR), we use the marketing and remarketing Services (“Google marketing services”) provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, (“Google”).

Google is certified under the Privacy Shield Framework and therefore guarantees that it will comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active). 

Google marketing services allow us to serve targeted advertisements for and on our website, in order to present users with only those advertisements that may be of interest to them. If, for example, a user is shown advertisements about products that the user has shown interest in on other websites, we refer to this as “remarketing”. For this purpose, when accessing our website or other sites where Google marketing services are active, Google code will be executed directly by Google and “(re-) marketing tags” (invisible graphics or code, also referred to as “web beacons”, will be incorporated in the website. These will be used to store an individual cookie (small data file) on the user’s device (equivalent technology may be used instead of cookies). The cookies may be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com and googleadservices.com. The file will record which websites the user visits, what content the user is interested in and which offers the user clicks on, along with technical information about the browser and operating system, referring websites, time of visit and other details about the use of the online services. The user's IP address will also be recorded; in the scope of Google Analytics, the IP address will be shortened within a member states of the European Union or another contracting state of the European Economic Area, and only transmitted in its full form to a Google server in the USA and shortened there in exceptional cases. The IP address will not be associated with the user data in other Google services. Google may link the information referred to above with similar information from other sources. If the user then visits other websites, targeted advertisements may be displayed based on the user's interests.

The user's data are processed pseudonymously for Google marketing services. That means that Google does not save and process e.g. the user's name or email address, but rather the relevant data cookie referenced from a pseudonymous user profile. Thus from Google's viewpoint, the advertisements are not managed and displayed for a concrete identifiable person, but rather for the cookie owner, regardless of who this cookie owner is. This does not apply if a Google user has expressly permitted their data to be processed without pseudonymization. The information collected about the user by Google marketing services is transmitted to Google and stored on Google servers in the USA.

The Google marketing services used by us include the “Google AdWords” online advertising scheme. With this scheme, each AdWords customer is assigned a separate “conversion tracking cookie”. It is therefore not possible to trace cookies via the websites of AdWords customers. The information collected using the cookie is used to generate conversion statistics for AdWords customers who have chosen to use conversion tracking. The AdWords customers obtain the total number of users who have clicked on their advertisement and been redirected to a site with a conversion tracking tag. However, they do not receive any information that could be used to personally identify users.

We may incorporate third-party advertisements using the “AdSense” Google marketing service. AdSense uses cookies that enable Google and its affiliate sites to serve ads based on users' visits to this site or other sites on the Internet.

In addition, we may use the “Google Tag Manager” to integrate and manage the Google Analytics and marketing services on our website.

Hosting

We use hosting services to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services. We use these services for the purpose of operating our online services.

We or our hosting providers may process status data, contact data, content data, contract data, usage data, metadata and communication data from customers, prospective customers, and visitors to our online presence, on the basis of our legitimate interest in making our online services efficiently and securely available, in accordance with Article 6(1)(f) GDPR in conjunction with Article 28 GDPR (Completion of Contractual Order Processing).

Collection of access data and log files

We, or our hosting provider, record data about every request to the server where our services are located (“server log files”), on the basis of our legitimate interest in the sense of Article 6(1)(f) GDPR. The access data include: the name of the website requested, filename, date and time of the request, volume of data transferred, report about successful access, browser and version, user operating system, referrer URL (the site visited just before), IP address and the provider queried.

For security reasons (e.g. to clear up cases of fraudulent or improper usage), log file information is saved for a maximum of seven days and then deleted. Data that must be stored longer for the purpose of providing evidence are exempted from deletion until final clarification of the relevant case.

Facebook pixel, custom audiences and Facebook conversion

As part of our online services, based on our legitimate interests in analysis, optimization and economic operation of our online services, and for these purposes, we use the “Facebook pixel” provided by the social network Facebook, operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are resident in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”).
Facebook is certified under the Privacy Shield Framework and therefore guarantees that it will comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active ).

Among other things, the Facebook pixel allows Facebook to identify the users of our online services as a target group for the display of advertisements (“Facebook ads”). We therefore use the Facebook pixel so that we can limit display of the Facebook ads sent to us to those Facebook users who have shown an interest in our online services, or who exhibit certain features (for example, interest in certain topics or products, as determined by the websites visited) that we transmit to Facebook (“custom audiences”). By using the Facebook pixel, we also aim to ensure that our Facebook ads match the user's potential interests and are not bothersome. Furthermore, using the Facebook pixel also allows us to trace the effectiveness of the Facebook ads for statistical and market research purposes, as we can see whether users were redirected to our website after clicking on a Facebook ad (“conversion”).

You can opt out of allowing the Facebook pixel to record and use your data for the display of Facebook ads. The settings are platform-independent, i.e. they apply to all devices, such as desktop computers, mobile devices.

Newsletter

You can sign up for our newsletter on our website. We will need your email address and your declaration that you consent to receive the newsletter.

In order to send you information appropriate to you, we also collect and process optional information about your areas of interest, contact details, country and language.

When you register for the newsletter, we will send you a confirmation email with a link to confirm your registration. For the purposes of managing newsletter distribution, the data specified above will be sent exclusively to SC-Networks GmbH (Enzianstr. 2, D-82319 Starnberg, Germany).

You can cancel your newsletter subscription at any time using the unsubscribe link included in every newsletter, or by emailing info@schladming-dachstein.at. We will immediately delete all of your data relating to the newsletter distribution.

Online social media presences

We maintain online presences within social networks and platforms in order to communicate with active customers, prospective customers, and users, and to inform them about our services. Access to a particular network or platform is subject to the terms and conditions and data guidelines of the particular operator.

Unless otherwise stated in our Privacy Policy, we process user data to the extent that the user communicates with us within the social networks and platforms, e.g. by publishing posts on our online presence, or sending us messages.

Accommodation providers

The data provided in an accommodation/holiday inquiry are transmitted to the accommodation providers for the purposes of finding accommodation. You can derive a complete list of recipients from the “Accommodation” list: Accommodation list

Reservation

If you reserve a room using Schladming-Dachstein, we collect from you the data necessary to make the reservation, in particular: your name, your telephone number, your email address (“contact data”) and the dates of your arrival and departure, your hotel and the type of room reserved (“reservation data”).

If you make a reservation with Schladming-Dachstein, your reservation data will be transmitted to the accommodation/service provider chosen by you, in order to actually make your reservation possible. Other than that, your data will not be transmitted to third parties. (Exception for data processing: see below). Your contact data will never be sold or lent by Schladming-Dachstein. Due to legal regulations and the corresponding legal or official provisions, we are obliged in exceptional cases to hand over data to the associated authorities or courts. This is only done in the context of our legal obligations.

Payment via credit card

You can use a credit card to pay on our website. Payment data will then be transmitted to the payment service, in order to carry out the payment. The legal basis for this processing of your data is Article 6(1)(f) GDPR. The payment service records the details of the transaction, plus further information related to the transaction such as information about goods/services, financial information, information about the interaction between you and the payment service, merchant information, including details regarding payment methods, device information and location data. The payment service uses the data for purposes including payment processing, credit checks, monitoring and improvements to its service.

User queries/email contact

When contacting the operator (e.g. through the contact form or by email), the following user details will be stored for processing of the query or in case of follow-up questions: title, first name and surname, email address, telephone number, street address, postcode, country, and any data relating to the inquiry (dates of visit, type of accommodation).

These personal data will be stored by the operator for twelve months after the inquiry is processed, and then deleted.

The personal data disclosed by the user are only processed and used by the operator to the extent necessary to handle the request and/or to provide the requested service.

Sweepstakes

From time to time you have the chance to participate in sweepstakes run by Schladming-Dachstein. As part of these activities, personal data (email, name, address) will be collected and processed for the purpose of the competition. The personal data collected as part of such a sweepstake will be used exclusively for the campaign (in the case of a sweepstake, for example, for determining the winner, informing the winner, and sending the winnings). Once the campaign has ended, the participants' data will be deleted.

The data provided by you in the course of a sweepstake will only be used to send you the newsletter if you have explicitly consented to this.

Job applications

The contact data and application documents transmitted to us as part of a job application are electronically processed by us for the purpose of selecting suitable candidates for an employment relationship. 

If you are turned down, the application documents will only be kept if you consent.

Hotjar

The operator uses a feedback and analysis service from Hotjar Ltd. (“Hotjar”), Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe, for the purposes of improving user experience on this website.

Hotjar enables the operator to measure and evaluate user behavior (mouse movements, clicks, scrolling, etc.) on the website. Hotjar places cookies on the user's end device for this purpose, and transmits the user's IP address to a Hotjar server, where it is stored in anonymized form for a maximum duration of one year.
