General Terms and Conditions of Use and Business

(hereinafter referred to as "GTC") for participation in the Schladming-Dachstein FürDich Club (hereinafter referred to as "SD Customer Club")

1.1 These General Terms and Conditions of Use and Business apply to participation in the Schladming-Dachstein Customer Club, hereinafter referred to as SD Customer Club, and represent the exclusive legal basis for participation. These GTC are available on the website of Schladming-Dachstein Tourismus GmbH at www.schladming-dachstein.at/agb and can be saved and printed out.

1.2 The SD Customer Club is a free offer from Schladming-Dachstein Tourismus GmbH. Depending on their membership status, SD Customer Club members enjoy various benefits, such as discounted event tickets, exclusive competitions, etc.

1.3 There is no entitlement to claim the benefits, as there may be limited availability and the services are free of charge. However, Schladming-Dachstein Tourismus GmbH will endeavor to ensure full availability of all benefits.

1.4 Schladming-Dachstein Tourismus GmbH reserves the right to supplement or reduce the services offered as part of the SD Customer Club.

All natural persons who have reached the age of 18 when the contract is concluded are eligible to participate. Persons under the age of 18 may participate with the consent of their legal guardians. Participation is free of charge. There is no legal entitlement to participate in the SD Customer Club. Participation in the SD Customer Club is tied to the person of the Customer Club member and cannot be transferred.

3.1 Registration is required to become an SD Customer Club member. This registration can be done online via www.schladming-dachstein.at/login or the Schladming-Dachstein App. By submitting the registration data (login data), the customer declares his legally binding participation in the SD Customer Club and his knowledge and consent to these GTC as well as his knowledge of the Schladming-Dachstein Tourismus GmbH data provisions (point 6.) and indicates the approved contact types for which he would like to receive legally binding information, whereby the selection of the contact type e-mail and the indication of a correct e-mail address are mandatory.

3.2 If applicable, the SD Customer Club Member consents to the processing of his/her personal data in accordance with the Privacy Policy.

3.3 The SD Customer Club member will be assigned a Customer Club number and access to the personal Customer Club account will be set up and activated

3.4 Each SD Customer Club member is entitled to only one Customer Club membership.

4.1 SD Customer Club membership is non-transferable. The SD Customer Club member must ensure that his SD Customer Club membership cannot be misused by third parties.

Every SD Customer Club member has a personal customer profile in which personal interests and activities can be noted. Such information is provided voluntarily if the customer wishes to do so in order to make better use of the benefits. Access to the bonus world is also via the customer profile.

5.1 SD Customer Club benefits

SD Customer Club members can access their profile at any time by logging in.

The SD Customer Club offers the following advantages:

The storage of personal data facilitates bookings and orders on the Schladming-Dachstein website. Insider tips such as special events or new offers are communicated to the SD Customer Club member based on the interests disclosed. Via the watch list in the SD Customer Club, the member can create and share an individual, personal vacation plan.

5.2 Acquisition of points

Every SD Customer Club member can find out how to collect points via the "Collect" menu item in the bonus world (https://bonuswelt.schladming-dachstein.at/sammeln/). The first points are already credited upon registration with the SD Customer Club. The options for collecting points can be adjusted or changed at any time.

Bookings made via Feratel using the same e-mail address – regardless of whether the user is logged in or not – are transferred to the FürDich Club. All bookings made with this e-mail address from the time of registration onwards are automatically linked and credited with points in the Bonuswelt (Incert).

5.3 Redeeming points

Collected points can be redeemed online at any time on the "Rewards" page https://bonuswelt.schladming-dachstein.at/praemien/. The available rewards are shown on this page. After selecting the reward, a voucher is downloaded with which the reward can be collected locally in the Schladming-Dachstein information offices or from the partner companies during the validity period.

It is also possible to purchase selected products by redeeming points and paying a fee directly at the Schladming-Dachstein Info Offices or at the relevant partner companies. Collection takes place in exactly the same way as with the free rewards, with the difference that the cost contribution is already paid online during the download process.

5.4 Bonus level system

The bonus level system is made up of four different member classifications. Up to 50 points - simple member, from 50 points: Bronze member status, from 150 points: Silver member status, from 300 points: Gold membership status

If points are redeemed for rewards, these redemptions do not affect the member status, which is retained in the background despite the redemption of points.

5.5 Expiry of points

Points expire automatically without entitlement to a replacement

- if they are not redeemed within 2 years (730 days) of the collection date

- on deletion of the SD Customer Club profile

5.6 Period of validity / termination

Participation in the SD Customer Club is open-ended. The customer may terminate the legal relationship in writing at any time with immediate effect. The legal relationship can also be terminated by deletion of the profile on the Schladming-Dachstein website or in the Schladming-Dachstein App by the SD Customer Club member himself.

Schladming-Dachstein Tourismus GmbH may terminate the legal relationship and participation for good cause.

5.7 Customer Club communication

By registering for the SD Customer Club, each Customer Club member agrees to receive information about the SD Customer Club both by post and electronically. It is possible to unsubscribe from the individual sections at any time and free of charge via an unsubscribe link.

5.8 Bus campaign - Your journey scores points

As part of the bus campaign, members of the customer club have the opportunity to collect Bonuswelt points by scanning a QR code on selected buses. Points are awarded once a day per bus route and are limited to a maximum of three entries per calendar year. The promotion is only valid on buses marked for this purpose.

5.9 Almkulinarik invoice scan - your enjoyment counts

As part of the Almkulinarik campaign, members of the customer club have the opportunity to collect Bonuswelt points by scanning the QR code on the invoice at participating culinary partners.

Points are awarded once per invoice and are only valid in the establishments participating in the program.

5.10. GreenRail campaign

As part of the GreenRail campaign, members of the customer club have the opportunity to collect Bonus World points by uploading their return ticket.

Points are awarded once per participation and only apply to tickets that prove an arrival and departure by public transport to the Schladming-Dachstein region and a minimum stay of two nights in the region. participating members also automatically take part in the "GreenRail competition".

6.1 The cash redemption of points or rewards and other SD Customer Club benefits is excluded.

6.2 Schladming-Dachstein Tourismus GmbH's liability for slightly negligent breaches of duty is excluded within the scope of use of the SD Customer Club, unless damages resulting from injury to life, body or health or guarantees or claims under the Product Liability Act are affected.

6.3 Furthermore, liability for the breach of obligations, the fulfillment of which enables the proper execution of the user relationship in the first place and on the observance of which the user may regularly rely, remains unaffected.

6.4 The above liability rules also apply to breaches of duty by partner companies of Schladming-Dachstein Tourismus GmbH.

6.5 Schladming-Dachstein Tourismus GmbH endeavors to make the SD Customer Club available without restriction. Technical maintenance and updates of the IT systems of the SD Customer Club will be carried out as far as possible without restricting availability. If this is not possible, Schladming-Dachstein Tourismus GmbH will endeavor to carry out maintenance and updates outside of operating hours. In the event of restrictions in availability, Schladming-Dachstein Tourismus GmbH shall endeavor to restore normal operation as quickly as possible.

7.1 Schladming-Dachstein Tourismus GmbH attaches particular importance to protecting the privacy and personal data of SD Customer Club members. However, in order to be able to offer SD Customer Club members various benefits, the collection of data is unavoidable. The Schladming-Dachstein data protection regulations (https://www.schladming-dachstein.at/de/Service/Datenschutz) regulate the responsible and transparent handling of personal data and which data is processed for which purposes.

7.2 SD Customer Club members must provide Schladming-Dachstein Tourismus GmbH with their customer master data (e-mail address, title, first name, surname and language) when registering. The following data can be filled in optionally: Travel dates, birthday, address, telephone number, country, profile picture. Schladming-Dachstein Tourismus GmbH must be informed of any changes to the data. This information can be provided via the SD Customer Club account, by email or by post. In addition, consent to profiling is optional and can be revoked at any time and free of charge by sending an email to digital@schladming-dachstein.at.

7.3 By agreeing to these GTC, the SD Customer Club member agrees that Schladming-Dachstein Tourismus GmbH may send legally significant and binding declarations (e.g. termination of membership) to the SD Customer Club member using at least one contact method approved by the member.

8.1 Schladming-Dachstein Tourismus GmbH may unilaterally make minor, objectively justified changes to these GTC within the meaning of § 6 para. 2 no. 3 KSchG at any time. These changes include in particular Expansion of eligible participants, changes that are made solely for the benefit of the SD Customer Club member, editorial adjustments and stylistic changes. The unilateral change to the GTC will be sent to the SD Customer Club members via at least one approved contact method.

8.2 Amendments to the GTC that exceed the level of insignificance and require the consent of the SD Customer Club Members in order to be valid will be sent to the SD Customer Club Members in at least one approved contact type in order to obtain their consent.

8.3 In the case of changes that do not affect the scope of services of the SD Customer Club, the consent of the SD Customer Club member is deemed to have been granted if Schladming-Dachstein Tourismus GmbH does not receive a written objection to the planned change within one month of delivery of the change letter. Any objections to Schladming-Dachstein Tourismus GmbH can be made in writing by e-mail.

9.1 Questions from SD Customer Club members can be answered during opening hours by calling +43 3687 23 310. Inquiries can also be made at any time via the Schladming-Dachstein website at https://www.schladming-dachstein.at/de/Service/Kontakt-Oeffnungszeiten.

9.2 Insofar as there are no mandatory statutory provisions to the contrary, the applicability of Austrian substantive law is agreed to the exclusion of the provisions of international private law and the UN Convention on Contracts for the International Sale of Goods.

9.3 Insofar as there are no mandatory statutory provisions to the contrary, the international jurisdiction of Austrian courts and the local jurisdiction of the court with subject-matter jurisdiction for the registered office of Schladming-Dachstein Tourismus GmbH at the time the claim is filed are agreed.
